Exploitation of Workers

A local man faced charges for the offence of profiting from the exploitation of two trafficked Bangladeshi workers.

Wan Nasyran bin Haji Osman, 44 years old was charged with one count under section 6 of the Trafficking and Smuggling of Persons Order, 2004 and two counts under section 7 of the Anti-Trafficking in Persons Act, Chapter 230. As the offence of profiting from the exploitation of trafficked persons took place between April 2019 and January 2021, the charges brought by the Public Prosecutor thus fall under both the Trafficking and Smuggling of Person Order, 2004 and the Anti-Trafficking in Person Act.

Meanwhile, Khairul Bashar, a Bangladeshi, was charged in relation to this case on 29 March 2022 with two counts under section 4 of the Trafficking and Smuggling of Persons Order, 2004 for committing the offence of people trafficking. Subsequently, on 11 April 2022, the Public Prosecutor brought four additional counts against Khairul Bashar for the same offence. Following their pleas of not guilty, the High Court fixed the case for trial in February 2023. If found guilty, both the defendants are liable to a fine not exceeding $1 million (BND$1,000,000), imprisonment for a maximum term of 30 years and whipping.
