In order to confirm the eligibility of the elected National Assembly deputies and People’s Council deputies, Article 88 of the Law on Election of National Assembly deputies and People’s Council deputies stipulates that, based on the results of the general election, National Assembly deputies, the results of settlement of complaints and denunciations related to the elected National Assembly deputies, the National Election Council shall confirm the eligibility of the elected National Assembly deputies and issue certificates. new National Assembly deputies to the elected candidates and report to the new National Assembly on the results of confirmation of the National Assembly deputies’ status at the first session.

Most localities elect enough delegates to the Provincial People’s Council

Preliminary statistics on election results and the list of candidates elected to the People’s Councils at all levels for the 2021-2026 term of the Election Commissions of the provinces, cities, most localities across the country have elected enough according to the specified quantity.

There are 5/63 provinces and cities directly under the Central Government that do not elect enough delegates to the People’s Council of the province/city according to the number of elected, that is: An Giang, Ca Mau, Tra Vinh, Vinh Phuc and City Ho Chi Minh. These provinces/cities all elect one delegate less than the number of elected members of the People’s Council of the province/city.

According to the report of the Election Commissions of the provinces/cities, although there are no cases of having to re-elect and elect more National Assembly deputies and Provincial People’s Council deputies, there are still some places where there is a re-electing and electing more deputies to the People’s Councils of communes and districts.

Specifically, additional elections took place: in Bac Ninh, 11 election teams from 9 communes in Luong Tai, Que Vo, Yen Phong and Thuan Thanh districts organized the election of 19 more commune-level People’s Council delegates for the 2021 term. -2026. Voting was completed on May 30.

In Thai Binh, 5 more deputies must be elected to the People’s Council of An Hiep commune (Quynh Phu district), Viet Hung commune (Vu Thu district) and Ha Giang commune (Dong Hung district) on June 6.

In Nam Dinh, the whole province has 18 constituencies, which have to hold additional elections for commune-level People’s Council deputies due to insufficient number of delegates to be elected.

In Kien Giang, there are 5 electoral units for People’s Council deputies at commune level (Minh Thuan commune, U Minh Thuong district; Dong Thai commune, An Bien district) and 1 district-level People’s Council election unit. (Kien Hai district) is not enough 2/3 of the number of delegates assigned, so an additional election must be held on June 6.

According to the Election Committee of Binh Phuoc province, constituency 5 of Long Tan commune (Phu Rieng district) elects more delegates to the People’s Council of the commune according to the law.

In Quang Nam, Thang Binh and Tien Phuoc districts each have to elect one more delegate to the People’s Council at the district level. As for delegates to the People’s Council at commune level, the whole province must elect 34 more delegates.

The organization of additional elections shall comply with the provisions of the Law on Election of deputies to the National Assembly and People’s Councils. Accordingly, in the first election at a constituency of National Assembly deputies, if the number of elected deputies to the 15th National Assembly is not enough for the number of elected deputies assigned to that constituency, the Committee shall The election of National Assembly deputies must clearly indicate in the minutes of election results and immediately report to the Election Commission in the relevant province or centrally run city to request the National Election Council for consideration. , decide on the election of more deputies to the 15th National Assembly in that constituency.

In the first election at a People’s Council deputies constituency, if the number of people elected as People’s Council deputies of that level for the 2021-2026 term is less than two-thirds of the number of elected delegates, For this constituency, the Election Board of People’s Council deputies of the respective level must clearly record in the minutes of determining the election results and immediately report it to the Election Commission in charge of organizing the election. delegates of the People’s Council at that level to decide on additional election dates in that constituency. In case of additional election, the election day shall be conducted no later than 15 days after the first election day.

In the additional election, voters choose to vote only from the list of candidates at the first election but are not elected. The winner is the person who gets more than half of the total valid votes and has the higher number of votes. If additional elections are held but the number of elected delegates assigned to the constituency is still insufficient, the second election shall not be held. Such constituency is defined as a constituency with a shortage of delegates (ie, after holding additional elections, it is still not possible to elect the number of delegates assigned to that constituency). The list of voters of the additional election is prepared according to the list of voters in the first election.

A number of constituencies for deputies to the People’s Councils of communes of Hanoi and Dak Lak will conduct re-election on June 6, 2021.

Accordingly, in Hanoi, due to violations in election work, the People’s Council deputies election unit at commune level 4, Hoang Long commune (Phu Xuyen district) and the People’s Council deputies election unit. People at commune level 4, Trang Viet commune (Me Linh district) must hold elections again. The Election Commission of Hanoi requested the Election Commission of Phu Xuyen district and the Election Committee of Me Linh district to direct the organization of re-election in the two constituencies of the commune-level People’s Council deputies mentioned above. on ensuring compliance with the provisions of the law.

In Dak Lak, there are 3 constituencies (9, 10, 11 in Cu San commune, M’Drak district) that must re-elect a delegate to the Commune People’s Council for the 2021-2026 term because less than 50% of the total number of voters who voted.

According to regulations, a re-election is an election conducted in constituencies where at the first election, the number of voters going to vote at the constituency does not exceed half of the total number of voters recorded in the election. the list of voters or the election is made in the polling station, the constituency there is a serious violation of the law in the first election and the election results are annulled at the discretion of the Election Board nation.

In the case of re-election, the election day shall be conducted no later than 15 days after the first election day. In the re-election, voters choose to vote only from the list of candidates at the first election. If the re-election is re-elected but the number of voters who turn out to vote still does not reach more than half of the total number of voters in the list of voters, the election results will be recognized without holding a second re-election. The list of voters for the re-election is made according to the list of voters in the first election.
