Why the EU Sides with Southeast Asia in the South China Sea Dispute

TAIPEI, TAIWAN – European Union members will step up their advocacy of open access to the disputed South China Sea, a key world trade route, despite Chinese claims to nearly all of it as they discuss the issue with Southeast Asian countries, analysts believe.

The 27 EU members, such as France and Germany, hope all countries can follow United Nations maritime rules in the South China Sea to ensure consistency with other world waterways and to protect a booming seaborne trade in goods with Asia, the experts say.

China claims about 90% of the 3.5 million-square-kilometer sea, including pieces of the U.N.-prescribed exclusive economic zones of four Southeast Asian states. Chinese officials point to maritime documents dating back to dynastic times to back their claim.

EU leaders met in early August with the 10-country Association of Southeast Asian Nations for discussions that touched on the South China Sea, and the two sides are due to convene again this quarter. The EU has met with the Southeast Asian association since 1977, part of the ASEAN’s series of dialogues with other major countries and regions.

ASEAN is the EU’s third-largest trading partner outside Europe, after China and the United States, with more than $221 billion in trade in goods last year.

About 60% of maritime trade by volume passes through Asia and about one-third goes through the South China Sea, the U.N. Conference on Trade and Development estimates. The sea is a connector between East Asia and the Indian Ocean, which puts ships on their way to Europe.

“The EU … has a big stake in the Indo Pacific region and has every interest that the regional architecture remains open and rules-based,” the European side said in a statement in April.

However, it continued, “current dynamics in the Indo Pacific have given rise to intense geopolitical competition, adding to increasing pressure on trade and supply chains as well as in tensions in technological, political and security areas.”

Neither the EU nor any of its member countries claim sovereignty over the South China Sea. ASEAN members Brunei, Malaysia, the Philippines and Vietnam call parts of the sea their own, overlapping China’s own boundary line, and Taiwan claims almost all of it.

France, Germany, and non-EU member Britain issued a joint note to the United Nations almost a year ago challenging China’s claims in the sea, which they view as a potential threat to international traffic.

“That’s pretty clear, they want consistency,” said Carl Thayer, Asia-specialized emeritus professor from the University of New South Wales in Australia.

“Why? Because the way you can do business. It lowers the risk,” he said.

Some EU positions on the South China Sea echo that of its Western ally, the United States, which regularly sends warships to the waterway as warnings to China. The EU’s website says, for example, that its members and ASEAN uphold “principles of a rules-based international order.”

EU nations have stepped up their own ship movements this year as well, but experts say they’re focused more on international law than with taking a pro-U.S. position.

If South China Sea claimants violate the U.N. Convention on the Law of the Sea, they would open the possibility for individual countries to control European seas, said Alexander Vuving, professor at the Daniel K. Inouye Asia-Pacific Center for Security Studies in Hawaii. The convention sets up exclusive economic zones for maritime states, among other provisions aimed at sharing cross-border waterways.

“Their primary interest is to maintain international law, maintain open freedom of navigation rather than siding with the United States in its strategic competition with China,” Vuving said.

Southeast Asian countries with claims to the South China Sea oppose Beijing’s landfilling of small islets for military use and passing its vessels through their exclusive economic zones.

However, they seldom use language that enrages China, a key Southeast Asia trade partner, and the EU backs that approach to the maritime dispute, Alan Chong, associate professor at the Singapore-based S. Rajaratnam School of International Studies, said. Both blocs look to China for trade as well.

“They are coming along to ASEAN in part because they are aware that ASEAN’s game is probably the surest and safest way of maintaining this dual policy of both engagement and constraining China,” Chong said.

Even the subtle language preferred by ASEAN is “enough to put Beijing on notice,” Chong said. China will probably avoid responding publicly but privately ask around for the meaning of any communiques that come out of the EU-ASEAN dialogue, he said.

Status of Several Services

The Ministry of Transport and Infocommunications would like to inform on the status of several major services, namely Application for Renewal of Vehicle and Driving Licenses Through Talian Darussalam 123, Registration of New Vehicles; Foreign Registered Vehicle Pass Sticker; Digital Office Methods and How to Ensure the Delivery of Letters and Parcels and Submit Complaints About Delayed Goods.

 

Talian Darussalam 123 has received numerous calls since the counter closed on the 9th of August 2021. One of the highest number of calls received at present is about Land Transport Department, LTD services, especially those related to renewal of vehicle and driving licenses. In this case, the additional alternative numbers that can be contacted for any queries or problems related to LTD services including renewal of Driving License or Vehicle License are 245 1980, 245 1982 and 245 1984 during working hours. The LTD is also concerned about the application to renew Vehicle and Driving Licenses among senior citizens who may face difficulties in applying online. In this regard, senior citizens are welcome to make calls or send WhatsApps to Talian Darussalam 123 to provide all the necessary information.

 

Vehicle inspections for Vehicle License renewals, 12 Vehicle Inspection Stations are still open with a fee of $5.00 for each inspection. The complete list can be found on LTD’s official website, ‘www.jpd.gov.bn’.

 

For driving licenses or vehicle licenses that have expired and have not been renewed, LTD has discussed with the Royal Brunei Police Force for the easing of regulations on any Driving and Vehicle Licenses that have expired as of 1st August 2021. For more inquiries, LTD provides FAQ or “Frequently Asked Questions” for the public’s information on LTD’s official website.

 

For the registration of new vehicles, starting Monday, 23rd of August 2021, the new vehicle registration service will be re-implemented through a procedure agreed upon between LTD and the Brunei Automobile Traders Association, BATA. Registration of new vehicles will use ‘running numbers’ beforehand to reduce customer or public interactions.

 

For Foreign Registered Vehicle Pass Stickers, the Ministry of Transport and Infocommunication through LTD has enforced the use of Foreign Registered Vehicle Pass Stickers on 1st of October 2020 for the purpose of identifying foreign registered vehicles.

 

To ensure the delivery of letters and parcels and to submit complaints about the delayed arrival of goods, the public who use mail and parcel delivery services in the country, should use the correct and complete addresses to enable a more efficient and effective delivery.

HIV Awareness Programme

The HIV Awareness Programme for Peers and Youth, in short HAPPY is one of the projects run by the AIDS Council of Brunei Darussalam to share information and prevention of HIV infection to the community, especially youth. Recently, the AIDS Council of Brunei Darussalam received the 2021 Outstanding Project Award for Youth for the project.

 

According to the HAPPY Project Coordinator, the programme which is conducted in one to two hours, among others, include a combination of various activities involving visual, audio and interactive to convey the message more effectively tailored to the values and identity in the country. Dayang Siti Kailene Binti Mohammad Jazlan Kashfi hoped as an advocacy, HAPPY will include reproductive health education in the formal education syllabus in Brunei Darussalam. They are also working on the HAPPY Programme for uniformed organisations such as the Royal Brunei Armed Forces, the Royal Brunei Police Force and others. HAPPY also encourages evidence based research and academic involvement of students and lecturers in the higher education on HIV and AIDS in the country.

 

Meanwhile, members involved in the HAPPY Project said the project motivates them to continue to be proactive in contributing and giving their best to shape the future of the country.

Enhance Capacity of National Vaccination Programme

The Ministry of Health continues to enhance the capacity of the National COVID-19 Vaccination Programme. The opening of the Jubli Emas Bunut Vaccination Centre which started operations last Tuesday is one of the ministry’s efforts so that more people and residents of the country receive the COVID-19 vaccination immediately.

 

The Jubli Emas Bunut Vaccination Centre operates on Monday to Thursday and Saturday from 8 in the morning to 2 in the afternoon and will close on Fridays, Sundays and public holidays. The COVID-19 Vaccine injection is provided free of charge for citizens and those residing in the country aged 18 years and above. According to the Ministry of Health, the COVID-19 Vaccine injection is the most effective measure to prevent the infection, together with the wearing of face masks at all times, physical distancing, maintaining personal hygiene and frequent hand washing.

11th ASEAN Youth Forum

The Brunei Youth Council and the ASEAN Youth Advocates Network Brunei Darussalam conducted the third and the final virtual workshop of the 11th ASEAN Youth Forum titled ‘Role of Youth in Community and Nation/Region Building.

 

The forum was followed by a discussion session participated by 75 delegates from the ten ASEAN Member States. The delegates produced the ASEAN Zine and ASEAN Youth Statement which will be presented during the closing ceremony on Friday, 27th of August.  The forum was also participated by Yang Berhormat Retired Major General Dato Paduka Seri Haji Aminuddin Ihsan bin Pehin Orang Kaya Saiful Mulok Dato Seri Paduka Haji Abidin, Minister of Culture, Youth and Sports as well as a Legislative Council Member. The forum is organized by The Brunei Youth Council in collaboration with the ASEAN Youth Advocates Network, AYAN with support from the Ministry of Culture, Youth and Sports; ASEAN Secretariat and the ASEAN Youth Forum as the media partner.

Strict Control Measures Extended until 4 September 2021

In the same statement, the Minister of Health also informed that by the consent of His Majesty the Sultan and Yang Di-Pertuan of Brunei Darussalam and taking into account the country’s infection situation which is still unstable, the control measures currently reinforced will be extended until Saturday, 4th of September 2021.

 

The Minister of Health also took the opportunity to urge the people to together control the spread of COVID-19. The cooperation of all parties is seriously hoped for particularly in being patient in obtaining provided services such as swab tests, COVID-19 vaccinations and Health Advice Line 148. Frontliners are working tirelessly to carry out their duties and responsibilities entrusted. The public should comply with all directives and advice issued by the Government.

122 New COVID-19 Cases

122 new COVID-19 cases were recorded in Brunei Darussalam, bringing the total cases to 1,455. Yang Berhormat Dato Seri Setia Doctor Haji Awang Mohd Isham bin Haji Jaafar, Minister of Health stated the matter at a media conference on the latest COVID-19 situation yesterday afternoon at Dewan Al ‘Afiah, Ministry of Health. Joining the media conference was Yang Berhormat Dato Seri Setia Doctor Awang Haji Mohd Amin Liew bin Abdullah, Minister at the Prime Minister’s Office and Second Minister of Finance and Economy.

 

There are additional cases to currently active clusters as follows: The Champion 7 and Surrounding Vessels: 9 cases for Champion 7 – Platform Cluster; and 2 cases for Champion 7 – Blue Titanium Cluster; 8 cases for the BSP HQ (Block M) Cluster; 8 cases for IBTE KB Cluster; 7 cases for Chung Hua KB Cluster; and 3 cases for 583 Cluster. Meanwhile, one new cluster has been identified with 4 related cases. This Cluster is now known as the 1385 Cluster.

 

In addition, there are 2 import cases recorded: Case 1332 arrived in Brunei Darussalam on 6th August 2021 on board flight Singapore Airlines SQ148 from United Kingdom. Case 1413 arrived in Brunei Darussalam on 8th August 2021 on board Royal Brunei BI684 from Manila. Meanwhile, there are 79 cases in which the source of infection is still being determined.

 

The cases in the active clusters are individuals who are currently being quarantined and were found to be in contact with several confirmed cases.

 

Contact tracing for all these new cases is currently ongoing. All identified close contacts are required to undergo mandatory quarantine and RT-PCR SARS-Co-V-2 test.

 

Meanwhile, 4 cases have recovered, bringing the total recovered cases to 355 cases. This means, a total of 1,096 active cases have been recorded in the country. Among the active cases, 3 cases are in critical condition, where two cases require ventilators and one case requires the help of an additional heart/lung machine, ECMO.
